Following many years’ experience in construction and surveying, dealing with commercial, industrial and residential buildings, and being involved in repair, refurbishment and new construction, Roy considers he has suitable experience to be an expert in contract disputes in these areas.
Negligence cases are also covered in areas of surveying and contract administration. Roy is not an expert in valuation matters.
Expert Reports are prepared for Court cases in connection with contractual disputes, building defects or boundary issues.
When considering the strengths of a building dispute case, we always advise clients of the benefits of a negotiated settlement because of the cost of litigation. If the matter cannot be so resolved, then full reports are prepared in accordance with the RICS Guidelines following the Wolff Report.
Expert Reports are also prepared and Court hearings attended in connection with the identification of building defects, the interpretation and scope of repair or maintenance contracts as well as comments on building works generally.
Expert Reports rely on the supply of correct historic data and documents from the client and benefit from an early involvement with the legal team in preparation of the case papers.
Roy Ilott's skill as an Expert Witness is based on his working experience in building surveying spanning over three decades.
Where necessary, we work with specialist land surveying firms to prepare accurate dimension of drawings of sites in such matters.
Instructions have been received from Mishcon de Reya in construction and negligence issues, from Boodle Hatfield in construction and boundary issues. Also from many other London, provincial and insurance company solicitors for disputes covering specific trade contracts, negligence cases, contract administration, performance of contractors, general quality and boundary cases.
