DILAPIDATIONS

Most building leases contain covenants defining the repairing liabilities between the parties, and stating the condition in which the property is to be yielded up at the end of the lease.

The lessor usually employs a surveyor to prepare and serve a Schedule of work necessary at the end of the lease and the lessee can employ a surveyor to contest the validity, reasonableness, extent etc., of the Schedule.

It should be remembered that whilst a tenant may have a liability under a lease from a head lessee, the lease to the sub-tenant may not protect the head lessee from all of the claim submitted by the freeholder.

Freeholders may not receive the cost of repairs which they expect if it can be shown that the reversionary value is affected to a lesser degree.
